A bootleg gun dealer has pleaded guilty to selling an AR-15 to mentally ill murderer Seth Ator, who used the weapon to kill seven people and wound 25 others in a roving mass shooting last year in Texas, federal prosecutors said.
Marcus Braziel admitted selling the powerful weapon in 2016 to Ator, 36, who had repeatedly failed to get one legally because he was deemed “mentally defective,” the US Attorney’s office said.
Ator used the rifle three years later as he fired indiscriminately for 10 miles between Midland and Odessa, before getting shot dead by cops.
Braziel, 45, now faces up to five years in federal prison after pleading guilty in US district court Wednesday to one count of dealing firearms without a license and one count of subscribing to a false tax return.
According to court documents, authorities seized 29 guns from Braziel’s home in July.
Braziel admitted he was “engaged in the business of selling firearms” – and admitted he did not do any background checks on his buyers, who would meet him at parking lots or his garage, prosecutors said. The tax charge was for hiding his illegal income.
Along with Ator, at least three others prohibited from owning firearms bought from Braziel — including a convicted felon and an illegal immigrant, prosecutors said.
The gun dealer is scheduled to be sentenced on Jan. 7.
“As this case makes clear, dealing firearms without a license isn’t some obscure, technical violation. It is unlawful conduct that has real-world impact and the potential for devastating results,” said US Attorney Erin Nealy Cox.
“The Justice Department is committed to enforcing our nation’s long-held gun laws, designed to prevent firearms from falling into the wrong hands.”
